Fort Collins Connexion (“Connexion”) is committed to safeguarding your personal information in compliance with applicable laws. This Privacy Policy outlines how we collect, use, protect, and share your information when you use Connexion’s Internet, TV, phone, and related services (“Services”). It also explains your rights and choices regarding your personal data.

1. When the Privacy Policy Applies

This Privacy Policy applies to personal information collected through use of Connexion services, including the Connexion website, platforms and covers data obtained from third parties. This policy does not apply to non-Connexion products, services, websites (such as City of Fort Collins websites), or third-party apps that customers may access through Connexion platforms. Some Services may have their own privacy practices described in a separate contract (e.g., Connexion Business Services). In such cases, the service-specific agreement will control.

2. Service Monitoring

Connexion has no obligation to monitor the Services but may do so and disclose information regarding the use of the Services for any reason if Connexion, in its sole discretion, believes it is reasonable to do so, as set forth herein, including to satisfy laws, regulations, or other governmental or legal requirements or requests; to operate the Services properly, or to protect itself and its customers.

3. Collection of Customer Information

Connexion collects information about its customers as necessary to provide the Services and to detect unauthorized reception or use of the Service. In order to provide reliable, high-quality service, Connexion keeps regular business records containing information about its customers, such as name, address, email address, telephone number, identifying information, financial information and other similar information. Connexion collects and maintains information about customer accounts such as billing, payment and deposit history, maintenance and complaint information, and the Services options Customers have chosen. In addition, Connexion may combine information it collects as a part of its regular business records with personally identifiable information obtained from third parties for the purpose of creating an enhanced database to use in marketing and other activities.
Connexion may use this information to:

  • Install, operate and maintain the Services
  • Confirm customers are receiving the level of Service requested and are properly billed for the Service
  • Identify and notify Customer when changes are made to their account
  • Inform customers of new products or services that may be of interest
  • Detect unauthorized reception of the Service
  • Determine whether applicable policies or the Terms and Conditions are being violated
  • Configure Service-related devices and equipment
  • Comply with applicable law and regulatory requirements
  • As otherwise necessary, to provide the Services or otherwise conduct business related to the Services

    Except as outlined in this Privacy Policy, the Acceptable Use Policy, or the Terms and Conditions, Connexion does not claim responsibility for, or exert control, ownership, or oversight over, customers’ email messages, websites, Internet usage history, voicemail, content, or other electronic data. While such data may be transmitted over or stored on Connexion’s equipment or facilities, Connexion only accesses or uses this information as necessary to provide and bill for the Services. Connexion may delete such information in accordance with applicable Service policies. Customers remain solely responsible for all such electronic data.

4. Internet and Phone Privacy

Connexion does not sell or share information that personally identifies who you are to anyone. Additionally, Connexion does not share, distribute, or sell a User’s email messages, specific Internet usage history, call history, voicemail, TV viewing or other electronic data generated from a User’s internet, phone, or video Service to any external third party. Connexion does not manage or monitor a User’s actions with respect to such User’s Internet and phone activities, but Connexion may manage or monitor the Internet and phone Services in order to provide support to Users, optimize such Services, comply with the law, and meet its obligations with respect to such Services.

5. Disclosure of Information

Update verbiage to: Personally identifiable information (“PII”) will only be disclosed for legitimate business activities related to the Services including, but not limited to:

  • Billing and collections
  • Account Administration
  • Surveys
  • Marketing
  • Maintenance
  • Fraud prevention
  • Compliance with applicable laws and regulations

Although Connexion makes every reasonable effort to preserve Customers’ privacy, Connexion will cooperate with law enforcement, including, without limitation, under subpoena, court order, or search warrant. As a governmental entity, Connexion may be required by state and federal law to disclose personally identifiable information about customers contained in Connexion’s business records as directed by state or federal law without Customer consent. In emergencies, or to enforce its rights in court or elsewhere, Connexion may use or disclose Customer’s personally identifiable information without consent in order to protect such customers, employees, or property. Connexion reserves the right to compile and share with third parties usage information in aggregated formats, such as ratings surveys and other statistical reports, so long as such information does not personally identify customers, their particular Services use habits, or the nature of any transaction an individual customer may have made using Connexion Services.

If necessary to render the Services or to conduct a legitimate business activity related to the Services, Connexion will sometimes disclose Customers’ personally identifiable information to others, such as outside auditors, professional advisors, service providers, potential business partners, regulators, and franchise authorities, with or without customers’ written consent.

6. Security

Connexion takes reasonable security precautions to protect personally identifiable information which Connexion collects when customers use the Services from unauthorized access, use, and disclosure. However, we Connexion cannot guarantee that its security precautions will prevent every unauthorized attempt to access, use, or disclose your personally identifiable information.

7. Marketing Services

From time to time, customer’s name and address might be disclosed for internal mailing lists in connection with the promotion of Connexion’s products and Services and other legitimate business activities, subject to the CPNI policies discussed below. If a customer wishes to remove their name from such lists or limit the use of their name and address at any time, please contact Connexion in person, in writing, or by telephone at (970) 207-7870. Customers opt-out preferences apply to marketing communications only and we may still send important Service-related messages as a user of the Services. Customers may not opt out of these Service-related and transactional communications.

8. Retention of Information

Connexion’s maintenance of personally identifiable information collected during the time customers have contracted with Connexion will be in accordance with the City of Fort Collins and Connexion’s document retention policy. Connexion destroys collected information consistent with the requirements of applicable law and the City of Fort Collins Utilities Records Retention Schedule when the purpose for which such information was collected has been accomplished and is no longer needed to retain the information for compliance with law, reporting, or other legitimate business activities.

9. Special Notice Concerning Customer Proprietary Network Information

In addition to the provisions of this Privacy Notice, federal law protects your privacy rights as a customer of Connexion’s phone Service. These rights are in addition to the existing safeguards that Connexion already has in place to protect your privacy rights. The Federal Communications Commission requires Connexion to notify you of your right to restrict the use of your Customer Proprietary Network Information (“CPNI”).

What is CPNI? CPNI is personally identifiable information that a telecommunications carrier collects when providing phone services to a customer. CPNI typically consists of the type of telephone Service, telephone numbers Customer has called, call duration and timing of those calls, as well as call frequency and any call management services Customer uses.

Permitted Use of CPNI by a Telephone Company Without Your Permission – Connexion may use CPNI for certain purposes without customer’s permission, including certain marketing. Connexion may also use CPNI to respond to customer inquiries regarding Services they currently use, or related services offered. In addition, Connexion may use CPNI for billing and collections, repair and maintenance, and to protect our property and to prevent fraud.

Additional Information Regarding Your CPNI Rights
Customer has the right to grant, deny, or withdraw Connexion’s access, or any other entity’s access, to customer’s CPNI at any time or to instruct Connexion to disclose CPNI to unaffiliated third parties by written request. Any approval or denial of the use of CPNI is valid until Connexion affirmatively revokes or limits such approval or denial. Denying access to CPNI will not affect Customer’s rights, access to Services, or Connexion’s obligations to Customer.

10. Network Information (CPNI)

11. Changes to This Privacy Policy

Fort Collins Connexion reserves the right to modify this Privacy Notice at any time. Connexion will notify customers of any material changes via written, electronic, or other means permitted by law. Customers have the right to cancel their Service in accordance with Connexion’s Terms and Conditions if they find such changes unacceptable. However, continued use of the Service indicates acceptance of the updated policy.
